A man from Midlothian who engaged in a sexual connection with a young schoolgirl for 11 months has been cautioned that he may be sentenced to imprisonment.
David Bracks engaged in sexual intercourse with a 13-year-old child when she was in a state of complete unconsciousness due to excessive alcohol consumption. This occurred at his previous residence after he met her at a nearby skate park.
Bracks, who has relocated to Manchester, confessed to initiating a relationship with the minor when he was 19 and engaging in sexual intercourse with her multiple times from December 2010 to October 2011.
Bracks, currently 34 years old, appeared at Edinburgh Sheriff Court on Wednesday and admitted to engaging in sexual conduct with a minor. This action involved kissing the youngster on the mouth, touching her body, and sexually penetrating her.
According to the court testimony, the victim, who was only 13 years old at the time, encountered Bracks at a skate park in August 2009. They, together with a group of friends, started drinking alcohol together.
A love relationship began between the two individuals following a period of early flirtation. The court was informed that throughout this time, the girl considered these encounters to be incredibly romantic.
During an encounter at the park, Bracks inserted his right hand into the girl’s trousers and engaged in sexual penetration before leaving to rejoin his friends.
Subsequently, Bracks transported the youngster to his previous residence in Midlothian and engaged in sexual activity with her on a mattress in his living room while she was in a state of complete unconsciousness due to excessive alcohol consumption.
According to court proceedings, Bracks consistently used a condom during their encounters, which took place regularly over 11 months. The girl was under the impression that they were in a romantic relationship.
Bracks terminated the connection in October 2011, and according to the court, the girl expressed a sense of “relief” upon their separation. In September 2021, the victim opted to inform the police about the incident she had experienced, citing mental health issues as the reason.
Bracks was apprehended, and during a police interrogation, he openly confessed to engaging in sexual activity with the youngster. He explicitly stated to the authorities that he had been anticipating this relationship to catch up with him for a decade.
Sheriff Derek O’Carroll registered Bracks as a sex offender and postponed the sentencing to obtain findings from the criminal justice social work. The sheriff stated that Mr. Bracks should fully comprehend that the court has complete freedom to consider all possible courses of action.
